AboutDisk Hub respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our platform.

1. DMCA Safe Harbor

AboutDisk Hub operates as an online service provider under Section 512 of the DMCA. We do not monitor all user-submitted content but will act expeditiously to remove or disable access to infringing material upon receiving a valid takedown notice.

2. Filing a DMCA Takedown Notice

If you believe that content on our platform infringes your copyright, please send a written notification to our designated DMCA agent containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, including the URL or other specific location on our platform where the material can be found.
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the District of Wyoming if you are outside the United States), and that you will accept service of process from the person who provided the original takedown notification.

5. Repeat Infringers

In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers. We may also, in our sole discretion, limit access to the platform or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys' fees.
